1. Accettazione

Usando Komorebi ("l'App") accetti questi Termini. Se non li accetti, non usare l'App. L'App è fornita da Itsukii Studio (Emanuele Pina), contatto supporto.komorebi@gmail.com. L'App è distribuita su Apple App Store (iOS) e Google Play (Android); per gli utenti iOS valgono anche i termini standard di licenza di Apple (Apple Standard EULA), per quelli Android i termini di Google Play. Apple e Google non sono parti di questi Termini e non sono responsabili dell'App né del suo supporto.

2. Il servizio

Komorebi ti aiuta a curare piante e bonsai: gestione delle piante e dei promemoria di cura, diario con foto, inventario dei prodotti, schede e articoli informativi, avvisi meteo facoltativi, esportazione dei tuoi dati.

3. Età e account

Devi avere almeno 14 anni. Per usare l'App serve un account (email e password). Sei responsabile delle tue credenziali e delle attività svolte con il tuo account; avvisaci subito a supporto.komorebi@gmail.com in caso di accesso non autorizzato. Puoi eliminare l'account in ogni momento da Profilo > Elimina account (vedi anche l'Informativa sulla Privacy). Possiamo sospendere account usati in violazione dei Termini.

4. Versione gratuita

L'App è gratuita con dei limiti sul numero di piante, di prodotti in inventario e di foto del diario per pianta. I limiti attuali sono mostrati nell'App. I limiti possono cambiare con avviso nell'App.

5. Acquisti in-app e abbonamenti

• Le funzioni premium si sbloccano con un abbonamento (mensile o annuale) o con un acquisto unico "accesso illimitato" (senza scadenza), tramite gli acquisti in-app di Apple o Google. I prezzi sono mostrati nello store prima dell'acquisto e possono variare per paese e valuta.
• Rinnovo automatico. Gli abbonamenti si rinnovano automaticamente per lo stesso periodo e allo stesso prezzo, a meno che tu non li disdica almeno 24 ore prima della fine del periodo in corso. Il pagamento è addebitato al tuo account Apple ID o Google Play alla conferma dell'acquisto e a ogni rinnovo.
• Disdetta. Apple: Impostazioni del dispositivo > [il tuo nome] > Abbonamenti. Google Play: app Google Play > Profilo > Pagamenti e abbonamenti > Abbonamenti. La disdetta vale dal termine del periodo già pagato; non ci sono rimborsi parziali del periodo in corso salvo quanto previsto dalla legge e dalle regole dello store. Eliminare l'account di Komorebi non annulla l'abbonamento: va disdetto nello store.
• Prove gratuite, ove offerte, passano ad abbonamento a pagamento alla fine della prova se non disdette in tempo.
• Ripristino acquisti. Puoi ripristinare gli acquisti già effettuati con "Ripristina acquisti" nell'App, usando lo stesso account store.
• Rimborsi. I pagamenti sono gestiti da Apple o Google: le richieste di rimborso vanno fatte a loro (reportaproblem.apple.com / Google Play). Non possiamo emettere rimborsi direttamente. Restano salvi i diritti dei consumatori previsti dalla legge, compreso il diritto di recesso dove applicabile e le regole dello store al riguardo.
• Se un acquisto non risulta sbloccato, usa "Ripristina acquisti" e, se il problema persiste, scrivici.

6. Uso consentito

Non devi: usare l'App per scopi illeciti; cercare di accedere ad aree o dati che non sono tuoi; decompilare, modificare o aggirare le protezioni dell'App; rivendere o sublicenziare l'App; caricare contenuti illeciti, offensivi o che violano diritti altrui; sovraccaricare o disturbare i servizi.

7. I tuoi contenuti

I contenuti che inserisci (piante, note, foto, inventario) restano tuoi. Ci dai una licenza limitata, non esclusiva e revocabile per conservarli ed elaborarli solo per fornirti il servizio. Non li vendiamo né li usiamo per pubblicità. Sei responsabile di ciò che carichi. Eliminando un contenuto o l'account, lo rimuoviamo come descritto nell'Informativa sulla Privacy.

8. Proprietà intellettuale

L'App, il suo codice, grafica e testi originali (comprese le schede e gli articoli) sono nostri o dei nostri licenzianti. Ti concediamo una licenza personale, non esclusiva, non trasferibile e revocabile per usare l'App sui tuoi dispositivi, per uso non commerciale.

9. Informazioni di cura e limitazione di responsabilità

Le indicazioni di cura, gli articoli e gli avvisi meteo sono orientativi e non garantiscono il risultato sulle tue piante, che dipende da molti fattori (clima, substrato, esposizione, specie). Gli avvisi meteo e le notifiche possono ritardare o non arrivare.

Nei limiti consentiti dalla legge: non rispondiamo di danni indiretti o consequenziali, né della perdita di piante; la nostra responsabilità complessiva non supera quanto hai pagato per l'App negli ultimi 12 mesi. Restano esclusi dai limiti i casi in cui la legge non consente di limitare la responsabilità (dolo, colpa grave, danni alla persona, diritti inderogabili dei consumatori).

10. Disponibilità del servizio

L'App dipende da servizi online (account, sincronizzazione, avvisi). Possiamo modificarla, sospenderla per manutenzione o interromperla; in caso di interruzione definitiva daremo un ragionevole preavviso e la possibilità di esportare i tuoi dati.

11. Modifiche ai Termini

Possiamo aggiornare i Termini; per modifiche sostanziali ti avviseremo nell'App o via email prima che entrino in vigore. Se continui a usare l'App dopo l'entrata in vigore, accetti i nuovi Termini; altrimenti puoi smettere di usarla ed eliminare l'account.

12. Legge applicabile e foro

Si applica la legge italiana. Le parti cercheranno prima una soluzione amichevole; in mancanza è competente il Tribunale di Como, salvo il foro inderogabile del consumatore del suo luogo di residenza o domicilio.

By using Komorebi (the "App") you accept these Terms. If you do not accept them, do not use the App. The App is provided by Itsukii Studio (Emanuele Pina), contact supporto.komorebi@gmail.com. The App is distributed on the Apple App Store (iOS) and Google Play (Android); iOS users are also covered by Apple's Standard EULA, Android users by Google Play's terms. Apple and Google are not parties to these Terms and are not responsible for the App or its support.

2. The service

Komorebi helps you care for plants and bonsai: plant and care-reminder management, photo diary, product inventory, informational guides and articles, optional weather alerts, export of your data.

3. Age and account

You must be at least 14 years old. An account (email and password) is required. You are responsible for your credentials and for activity under your account; tell us at once at supporto.komorebi@gmail.com about any unauthorised access. You can delete your account at any time from Profile > Delete account (see also the Privacy Policy). We may suspend accounts used in breach of these Terms.

4. Free version

The App is free with limits on the number of plants, inventory products and diary photos per plant. Current limits are shown in the App. Limits may change with notice in the App.

5. In-app purchases and subscriptions

• Premium features are unlocked by a subscription (monthly or yearly) or by a one-time "unlimited access" purchase (no expiry), through Apple or Google in-app purchases. Prices are shown in the store before purchase and vary by country and currency.
• Auto-renewal. Subscriptions renew automatically for the same period and at the same price unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID or Google Play account at purchase confirmation and at each renewal.
• Cancellation. Apple: device Settings > [your name] > Subscriptions. Google Play: Google Play app > Profile > Payments & subscriptions > Subscriptions. Cancellation takes effect at the end of the period already paid; no partial refund of the current period except as required by law and store rules. Deleting your Komorebi account does not cancel your subscription: cancel it in the store.
• Free trials, where offered, convert to a paid subscription at the end of the trial unless cancelled in time.
• Restore purchases. You can restore previous purchases with "Restore purchases" in the App, using the same store account.
• Refunds. Payments are handled by Apple or Google: refund requests go to them (reportaproblem.apple.com / Google Play). We cannot issue refunds directly. Statutory consumer rights, including withdrawal rights where applicable and the stores' rules on them, are unaffected.
• If a purchase is not unlocked, use "Restore purchases" and, if it persists, contact us.

6. Acceptable use

You must not: use the App for unlawful purposes; try to access areas or data that are not yours; decompile, modify or circumvent the App's protections; resell or sublicense the App; upload unlawful or offensive content or content that infringes others' rights; overload or disrupt the services.

7. Your content

Content you enter (plants, notes, photos, inventory) remains yours. You grant us a limited, non-exclusive, revocable licence to store and process it solely to provide the service. We do not sell it or use it for advertising. You are responsible for what you upload. When you delete content or your account we remove it as described in the Privacy Policy.

8. Intellectual property

The App, its code, graphics and original texts (including guides and articles) belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on your devices for non-commercial use.

9. Care information and limitation of liability

Care guidance, articles and weather alerts are indicative and do not guarantee results for your plants, which depend on many factors (climate, substrate, exposure, species). Weather alerts and notifications may be delayed or not delivered.

To the extent permitted by law: we are not liable for indirect or consequential damages or for the loss of plants; our total liability does not exceed what you paid for the App in the last 12 months. These limits do not apply where the law does not allow limiting liability (wilful misconduct, gross negligence, personal injury, mandatory consumer rights).

10. Availability

The App depends on online services (account, sync, alerts). We may change it, suspend it for maintenance or discontinue it; for a permanent shutdown we will give reasonable notice and the chance to export your data.

11. Changes to the Terms

We may update the Terms; for material changes we will notify you in the App or by email before they take effect. If you keep using the App afterwards you accept the new Terms; otherwise you may stop using it and delete your account.

12. Governing law and courts

Italian law applies. The parties will first seek an amicable solution; failing that, the Court of Como has jurisdiction, without prejudice to the mandatory forum of a consumer's place of residence or domicile.
